Former member of the IRGC?
In April 2019, the U.S. government designated Iran’s Islamic Revolutionary Guard Corps (IRGC), Sepah or Pasdaran, a foreign terrorist organization. The IRGC is a branch of the Iranian armed forces that operate independently of the regular army. Still, the IRGC designation marks Washington’s first stamp as a foreign government entity, a terrorist group. Designating a group as a terrorist organization has profound immigration implications for anyone associated with such an organization, including for unacceptable reasons that are nearly irreparable.
Our firm is familiar with the unique issues facing those seeking immigration to the United States from Iran.
In Iran, military service is compulsory for men, with some exceptions.
Kameli & Associates notes that it takes no position regarding the political relationship between the U.S. and Iran and the motivations underlying the U.S. government’s designation of the IRGC as a terrorist organization. However, implementing TRIG bars without substantial waivers regarding involuntary or implied service of prior assignment has created confusion and uncertainty. It is a problem that increasingly applies to hundreds of thousands of U.S. citizens, permanent residents, and U.S. employers. The current petition by Kameli & Associates is intended to help alleviate these growing problems.
